Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website fractaltradersfx.com and the software products offered by The Fractal Traders FX ("we", "us", "our"), operated by Yatharth Deepak Hatwar from Nagpur, Maharashtra, India.

By creating an account, purchasing a license, or using our Expert Advisor (EA) software, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Product Description

We provide algorithmic trading software ("Expert Advisors" or "EAs") designed for the MetaTrader 5 platform. Our flagship Crypto EA executes automated trades on cryptocurrency CFD instruments (primarily BTCUSD and XAUUSD) based on a proprietary algorithm. The software is licensed per MT5 account on a subscription basis.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a contract in your jurisdiction. By using the Service you confirm that you meet these requirements.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current information during registration and to update it as needed. You are responsible for all activity that occurs under your account.

4. License Terms

Upon successful payment, you receive a non-exclusive, non-transferable, revocable license to use the EA software, subject to the following:

• One license = one MT5 account. The license auto-binds to the first MT5 account on which it is activated.
• You may not share, resell, sublicense, copy, redistribute, decompile, or reverse-engineer the EA.
• Account changes are permitted only through our official account change request process, subject to manual review.
• License keys are valid only for the duration of your active subscription.
• We retain the right to revoke any license found in violation of these Terms.

5. Subscription and Billing

Subscriptions are available in monthly, 3-month, and yearly billing cycles. Payment is collected upfront at the time of purchase. We do not auto-renew subscriptions — you must manually purchase a new subscription cycle from your dashboard when the current one expires.

All payments are processed through Razorpay. Prices displayed include applicable taxes unless otherwise stated.

6. Free Trial

We may offer a 7-day free trial. Trial accounts have full functionality on one MT5 account. At the end of the trial period, the license deactivates automatically unless you purchase a paid subscription. No payment information is required to begin a trial.

7. Refunds

Refunds are governed by our Refund Policy. In summary: refunds are available within 7 days of purchase only if the EA fails to operate as described due to a technical issue we cannot resolve. Trading losses do not qualify for refunds.

8. Risk Disclosure

Trading foreign exchange, cryptocurrency CFDs, and other leveraged instruments carries a high level of risk and may not be suitable for all investors. By using our EA software, you acknowledge and accept that:

• You may lose some or all of your invested capital.
• Past performance — including any verified results displayed on this website — does not guarantee or predict future results.
• The EA executes trades automatically; you are solely responsible for monitoring its activity on your account.
• Market conditions, broker execution quality, spread, slippage, and other factors outside our control will affect your results.
• You should not invest money that you cannot afford to lose.

9. No Investment Advice

Our software, website, and any communications from us do not constitute financial, investment, or trading advice. We are not registered investment advisors or financial planners. You should consult an independent licensed financial advisor before making any investment decisions.

10. User Responsibilities

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to circumvent the license validation system
• Share your account credentials or license keys with third parties
• Reverse-engineer, modify, or create derivative works of the EA
• Interfere with or disrupt the Service infrastructure
• Misrepresent your identity or impersonate others

11. Limitation of Liability

To the maximum extent permitted by law, The Fractal Traders FX and its operator shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to trading losses, lost profits, or loss of data, arising from your use of the Service. Our total cumulative liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Intellectual Property

All EA software, source code, algorithms, website content, branding, and documentation are the exclusive property of Yatharth Deepak Hatwar / The Fractal Traders FX. No rights are transferred to you beyond the limited license granted in Section 4.

13. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your license is revoked and access to the EA is disabled. Any pre-paid subscription amounts may be forfeited if termination is due to your breach of these Terms.

14. Modifications to Service or Terms

We may modify, suspend, or discontinue any aspect of the Service at any time. We may update these Terms; material changes will be communicated via email to registered users. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra.
